About Your Financial Adviser

As a Financial Adviser, it is her duty to abide by the Code of Conduct for Financial Service Providers.

We are by the providers for the services we provide, however, it is you that we work for. To ensure that we put your interests ahead of our own, we follow a 6-step advice process when providing personalised financial advice which is based on your individual goals and needs.

We provide all of our recommendations in writing so that you have the opportunity to ask any questions you might have before implementing any of my advice.

Life and Health GuardiaNZ, and anyone who gives financial advice on our behalf, has duties under the Financial Markets Conduct Act 2013 relating to the way that we give advice.

About Your Financial Adviser

Life and Health GuardiaNZ, and its advisers that provide regulated suitable financial advice (including your adviser), are required to comply with duties under the Financial Markets Conduct Act 2013 when providing regulated financial advice to retail clients.

These duties include:

▪ meeting the standards of competence, knowledge, and skill set out in the Code of Professional Conduct for Financial Advice Services;

▪ meeting the standards of ethical behaviour, conduct, and client care set out in the Code of Professional Conduct for Financial Advice Services;

▪ giving priority to our clients’ interests and needs; and

▪ exercising utmost care, diligence, integrity and up-to-date skill in providing suitable financial advice.

Our Services

Personal Risk: (Life, Income, Disability & Health Insurances):

Our recommendation is limited to the products offered by AIA Group

As your insurance broker, you will only receive advice from us that relates to contracts of life, disability and health insurance, including the renewal or variation of the terms or conditions of an existing contract of life, disability and health insurance.

We use our professional judgement in providing advice and arranging insurance cover for you, based on the requirements you have notified us. This means that we may only approach a limited number of insurers in placing your cover.

We cannot guarantee the availability of insurance for your particular risks or the solvency of insurers. Neither Life and Health GuardiaNZ nor any of its advisers provide financial advice in relation to any other financial products nor any valuation relating to your insurance.

Other Service Providers:

I may refer you to other service providers, including Generate KiwiSaver and Generate Managed Funds. Therefore, I need to disclose that if you decide to invest with Generate, I will receive a commission for referring you. The commission is an ongoing payment of 0.125% of your account balance. This fee is paid to me by Generate from the revenue they receive from the fees you pay.

Your Privacy is Protected

All information that you give is collected, stored and used only in accordance with the Privacy Act 2020. We uphold our duty to maintain confidentiality and securely store client information. We will obtain consent before collecting client information. The Financial Markets Authority (FMA) New Zealand reserves the right to view and obtain our client records, for the purpose of auditing our compliance with the FMC Act and regulations.

We share your Personal Information with third parties that we partner with to provide our services. For example, the information we collect will be shared with the chosen insurance provider.

We may also disclose your Personal Information to abide with applicable laws and regulations, to respond to a subpoena, search warrant or other lawful request for information we receive, or to otherwise protect our rights.

We may update this privacy policy from time to time in order to reflect, for example, changes to our practices or for other operational, legal or regulatory reasons. Our Remuneration as a Financial Adviser

Life and Health GuardiaNZ does not charge fees to you, however, we will receive commission and remuneration from the insurance provider/companies who issue your policy. The commission is calculated based on the percentage of the premium price. For more information, please refer to your Adviser’s Disclosure Statement.

We’ll receive commissions from the relevant insurance company if you take out insurance following our advice. The commissions are between 30% and 120% for health insurance and between 150% and 200% for personal risk insurance based on the first year's premiums of your policy. The amount depends on which insurance company and which insurance policy you choose. We also receive a renewal commission of between 5% and 10% of the premium for each subsequent year the policy remains in force.

Conflict of Interest

We take any perceived or real conflicts of interest very seriously and have a dedicated policy and procedure for dealing with such issues whereby we avoid, disclose and/or manage any conflicts so that our client’s interests are placed first and foremost.

We manage all conflicts of interest, ensuring our financial advisers prioritise your interests above their own, by following an advice process that ensures our recommendations are made on the basis of your needs and circumstances. All of our financial advisers complete training to understand and manage conflicts of interest. We maintain a register of conflicts of interests and any gifts and other incentives that we may receive. We review our compliance programme annually.

If our financial adviser has a conflict of interest in circumstances where financial advice has been provided to more than one client who may have a dispute later on, we will clearly disclose the conflict of interest to the clients and will refer one of them to another financial adviser who may be able to assist them without prejudice.
